Introduction
Global Pet Register Limited (“Global Pet Register”/”we”/”our”/”us”)
You must read, agree with and accept all of these terms prior to using our Service. We recommend that you keep a copy of these terms for your records.
The following terms apply to the entire content of our website at http://www.gprsos.com/ (“website”) and to any correspondence between you and us.
Lost and Found Service
Global Pet Register provide users with a unique online resource for the purpose of reuniting lost pets with their respective owners.
We provide a service in which users register their pets against a product of the Global Pet Register range which includes a unique identification number linking them to their pet.
If found, the finder either calls our 24/7 UK Support Center or notifies us via our website online of the found pet. We will facilitate contact with you (or your alternative contacts provided within your personal online profile, should we not be able to reach you in the first instance) and the individual in possession of, or with information regarding, a pet belonging to you (the “Service”).
Legal Requirements
Our Service is available only to individuals who are legally capable of entering into binding contracts and who are at least 18 years of age. Our Service is not available to minors, or to temporarily or indefinitely suspended internet users. A minor can only use this Service in conjunction with parental or guardian authority. If you do not qualify, please do not use our Service.
Registration Obligations
By using the Global Pet Register Service you agree to provide and maintain true, accurate, current and complete information about yourself, and your alternative contacts supplied by you within your personal online profile, as requested by the required forms.
The content of the information will be decided and provided by you and it is your sole responsibility to keep your information accurate and up-to-date. We will not be liable for any incorrect and/or out of date information provided by you.
You are able to update or amend your information at any time via our website, sign in under Login and enter your username and password.
If you provide any information that is untrue, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we retain the right to suspend or terminate your Global Pet Register account, and refuse any, and all current or future use of the Service (or any portion thereof).
Password and Security
Your email address and password is required for the registration process. Responsibility for the security and proper use of your password rests with you. You must keep your password safe and not disclose it to any other person. You agree to immediately notify us of any unauthorised use of your password, or account, or any other breach of security. You ensure that you exit from your account at the end of each session. We accept no liability for any loss or damage arising out of any unauthorised or improper use or disclosure of the password or the consequences of such.
Identity Verification
Since user verification on the internet is difficult Global Pet Register cannot and does not confirm each user's purported identity.
For Your Safety and Security
Global Pet Register will never disclose your personal data to any finder.
Global Pet Register will allow you and the finder (if the finder agrees) to communicate directly to exchange the pet, by forwarding the finder’s contact details to you or your designated contacts. We cannot be held liable for any security or theft related incidents arising out of this direct communication.
Please use caution and common sense when using our Service. Please note that there are risks in dealing with people acting under false pretense. Do not, under any circumstances, send money to any person requesting payment for the return of your lost pet. Please report any suspicious activity to your local police.
WE STRONGLY RECOMMEND THAT EXCHANGES OCCUR ONLY AT SECURE LOCATIONS SUCH AS LOCAL POLICE STATIONS, ANIMAL SHELTERS OR OTHER PUBLIC AREAS.
Contracts (Rights of Third Parties) Act 1999
For the purposes of the Contracts (Rights of Third Parties) Act 1999 this contract is not intended to, and does not, give any person who is not a party to it any right to enforce its provisions.
Our Liability
The use of the Service is at your own risk. The Service is provided on an ‘as is’ and ‘as available’ basis. Global Pet Register disclaim all warranties or conditions, express or implied, including without limitation, implied warranties and conditions of merchantability and fitness for a particular purpose or non-infringement. We exclude any liability for any claims arising under civil law including claims under contract or tort.
This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded, or limited, under applicable law.
Global Pet Register make no warranty that the Service will meet your requirements and that the Service will be uninterrupted, timely or error-free. Any material downloaded or otherwise obtained through the use of the Service is done at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
Global Pet Register shall not be liable for any direct, indirect, incidental, punitive, exemplary or consequential loss or damages, including but not limited to loss of profits or contracts, financial loss, loss of income or revenue, loss of business, loss of anticipated savings, loss of goodwill, loss of data or other intangible losses, resulting from the use or the inability to use the Service, loss or damage to personal property through a transaction entered into through or from the Service, unauthorized access to or alteration of your transmissions or data, statements or conduct from any third party on the Service, or any other matter relating to the Service.
Global Pet Register do not guarantee or ensure the return of any lost pet or the condition of any lost pet. You are required to comply with the Control of Dogs Order 1992. Global Pet Register is not a substitute for this.
Global Pet Register 's text and phone Services rely on third party mobile networks and phone operators; we therefore cannot be held responsible for the non-delivery or any delay of our Services where this is caused by a third party network or operator.
Global Pet Register shall not be liable if, through fraud, deceit or other means, a person or persons falsely claiming to have found a pet.
Conduct
You are responsible for all content, that means information, data, text, photographs, or other materials, that you upload or post on the website. We do not control the content, so therefore we cannot guarantee the accuracy or quality of such content.
All content will be decided and provided by you. We will not be liable for any incorrect and/or out of date content provided by you.
You are prohibited from posting to or from the website any material that is unlawful, confidential, harmful, defamatory, threatening, obscene, indecent, offensive, pornographic, abusive, discriminatory, racially, ethnically or otherwise illegal, unlawful, or in breach of any criminal or civil law, including the intellectual property rights of others, not only within this jurisdiction but in any foreign jurisdiction.
You are prohibited from posting to or from the website any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
Global Pet Register shall have the right (but not the obligation) at its sole discretion to refuse or move any content that is available via the Service. Without limiting the foregoing, Global Pet Register shall have the right to remove any material it deems objectionable.
You acknowledge and agree that Global Pet Register will fully co-operate with any law enforcement authorities or court order if requested to do so.
Modifications to the Service
Global Pet Register reserve the right to modify, discontinue, close, temporarily or permanently, the Service (or any part thereof) at any time. You agree that Global Pet Register shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service (or any part thereof). Global Pet Register reserve the right to cancel or terminate any service by giving 7 working days notice. Global Pet Register also reserves the right to cancel or terminate any service with no notice period in the event of misconduct or abuse of the Service.
Global Pet Register ’s Termination Rights
You agree that Global Pet Register at its sole discretion, may terminate your password and account (or any part thereof) or use of the Service, and remove and discard any content within the Service, for any reason, including, without limitation, for lack of use or if Global Pet Register believe that you have violated or acted inconsistently with the letter or spirit of these terms. Any abuse of our Service, including the excessive notification (i.e. four notifications within one year) via our 24/7 UK Support Centre, each notification registered under one ID number, may result in Global Pet Register terminating the Service or requesting an additional fee.
You agree that any termination of your access to the Service under any provision of these terms may be effected without prior notice, and you agree that Global Pet Register may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. You agree that Global Pet Register shall not be liable to you, or any third party, for any termination of your access to the Service.
Indemnity
You agree to hold Global Pet Register , its subsidiaries, affiliates, directors, officers, agents, consultants, co-branders or other partners, and employees, harmless from any claim or demand, including legal fees, made by you or any third party due to the Service we provide to you.
Intellectual Property
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial or private purposes, any portion of the Service, use of the Service, or access to the Service without prior agreement with Global Pet Register .
You acknowledge and agree that the Service and any software used in connection with the Service contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorised by Global Pet Register or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the software, in whole or in part.
Global Pet Register logo, trademarks and service marks, and other internet, product and service names are trademarks of Global Pet Register. Without Global Pet Register ’s prior permission, you agree not to display or use Global Pet Register marks in any manner.
Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with English Law. You agree to submit to the exclusive jurisdiction of the courts of England and Wales over any dispute that arises.
